Srinagar, Oct 24: The High Court of J&K and Ladakh has quashed an order passed by the Central Administrative Tribunal (CAT) in contempt proceedings involving issuance of non-bailable warrants against Shakeel Ahmad Romshoo, vice Chancellor IUST Awantipora, even as it protected the post of librarian for the candidate, Dr Imran.
A Division Bench comprising Chief Justice Pushpendra Singh Bhati and Justice Muhammad Yousuf Wani passed the direction while disposing of a plea filed by Romshoo against CAT order in a case related to Librarian Sheikh Muhammad Imran. The bench directed the tribunal to finally decide the pending original application within three months. The dispute concerns Imran’s right to serve at IUST as librarian.
The High Court noted that the substantive controversy remains pending before the CAT and has yet to be finally adjudicated.
The court was informed that Imran had joined back at the University of Kashmir on September 22 this year, and was discharging his duties as Librarian there.
His counsel Faizan Majeed Bhat informed the court that he was compelled by noncompliance of CAT orders to join back at KU.
His subsequent joining constituted a later development and that any further movement could prejudice his rights, Bhat said.
Imran’s counsel submitted that the joining at KU was under protest and in pursuance of the CAT’s September 14 order.
The counsel argued it would be appropriate either to decide his right to serve at the IUST as librarian.
The court observed that, in the larger interest of Dr Imran, the pending Original Application should be decided expeditiously
The court further ordered that the Original Application be finally decided within three months.
It also protected Imran’s right to the post of Librarian at the Islamic University, subject to the final outcome of the OA.
