Srinagar, Sep 26: The 2nd Additional District Judge, Srinagar, Naushad Ahmad Khan, has declined to grant interim relief seeking deferment of the Jammu & Kashmir Cricket Association (JKCA) Annual General Meeting (AGM) scheduled for September 27, 2026 in Jammu.
As per a statement issued by JKCA on Saturday, the matter came before the court in an application filed under Section 151 of the Code of Civil Procedure, seeking deferment of the AGM proposed pursuant to the JKCA notice dated September 6, 2026. “The application was filed in a pending civil suit instituted by Javed Ahmad Kitab, who has claimed to be the elected President of the JKCA. The underlying dispute relates to his alleged suspension and subsequent constitution and functioning of the Apex Council and appointment of an Ombudsman,” read the statement.
The statement further added, that in his order dated September 26, 2026, Judge Naushad Ahmad Khan considered the plea for interim restraint against the AGM but declined to halt the meeting. In a separate proceeding concerning the AGM, the court also considered pleas challenging the JKCA notice and alleged non-compliance with provisions of the JKCA Constitution. The court made an important clarification that dismissal of the interim application does not amount to a final determination on the legality or validity of the AGM notice. Issues relating to constitutional compliance, authority to issue the notice, circulation of requisite material and validity of resolutions passed at the AGM have been left open for adjudication in the appropriate proceedings.
The court further observed that the applicants had not established the necessary grounds for interim injunction, including a sufficient prima facie case, balance of convenience and likelihood of irreparable injury. Accordingly, the JKCA AGM scheduled for September 27 is not restrained by the interim orders passed by the court. The order was passed by Naushad Ahmad Khan, 2nd Additional District Judge, Srinagar, on September 26, 2026.
